Mathew Hoffman recently authored a published article along with Jason Cohen and associate Michael Ward. Featured in the Spring issue of Paradigm Magazine, the article examines the legal differences between sale leasebacks and loans and the risk of using sale leasebacks, particularly in the art financing world. The piece details a recent case in which Barton obtained an appellate affirmance of an injunction the firm had won for its clients by focusing the courts on the realities of the agreements in question, notwithstanding the way they were characterized by the parties.  Barton’s victory was, to our knowledge, the first time a debtor had prevailed in such a recharacterization of its own agreements.
